erms of Service – Custom Moto Graphics

These Terms of Service (“Terms”) apply to all orders, products, and services provided by Red Earth Innovations, LLC, including but not limited to custom moto graphics kits, decals, wraps, and design services.

By placing an order, the customer agrees to these Terms in full.

Quotes & Estimates

Quotes
A quote issued by Red Earth Innovations, LLC is a legally binding offer. Acceptance of a quote constitutes agreement to pay the full quoted amount.

Estimates
Estimates are non-binding and provided for informational purposes only. Final pricing may change based on actual materials, labor, customization details, or scope of work.

Custom Products & Order Accuracy

All moto graphics are produced to order based on customer-provided or customer-selected information, including bike model, year, trim, sizing, colors, names, numbers, and artwork.

The customer is solely responsible for verifying the accuracy of all order details and approved proofs. Red Earth Innovations, LLC is not responsible for errors approved or provided by the customer.

Customer-Provided Logos & Intellectual Property Rights

The customer represents and warrants that they have full legal rights, authorization, and permission to use any logos, trademarks, brand names, images, or copyrighted materials requested for inclusion in custom graphics, decals, wraps, or artwork.

Due to the volume and nature of custom orders, Red Earth Innovations, LLC cannot verify ownership or permitted use of every logo or trademark requested. Responsibility for verifying legal usage rests solely with the customer.

The customer agrees to indemnify and hold harmless Red Earth Innovations, LLC from any claims, damages, losses, costs, or legal actions arising from the unauthorized or improper use of logos, trademarks, or copyrighted material provided or requested by the customer.

Production & Delivery Time

Most products are custom made and typically ship within 2–3 weeks from the date of purchase. Production timelines may vary due to workload, material availability, or customization complexity.

Delivery timelines are estimates only and are not guaranteed.

Shipping & Pickup

Orders may be shipped via major carriers or drop-shipped from third-party suppliers. Shipping fees are billed to the customer.

Local pickup may be permitted at the seller’s discretion.

Risk of loss transfers to the customer once the product is picked up or accepted by the carrier.

Product Inspection & Acceptance

The customer must inspect all products immediately upon delivery or pickup.

Any damage, defects, or issues must be reported immediately. Failure to report issues upon receipt constitutes acceptance of the product.

Claims submitted after installation, use, or modification will not be honored.

Risk & Liability

The customer assumes all liability for the product once it has been picked up or delivered.

Red Earth Innovations, LLC is not responsible for:

  • Installation errors

  • Improper application

  • Vehicle damage

  • Personal injury

  • Normal wear and tear

  • Damage occurring during transport or use

Payment Terms

Full payment is required before production, shipping, or pickup.

Orders will not be released or shipped until payment is received and confirmed.

Chargebacks or payment disputes filed without prior contact may result in order cancellation, warranty voidance, and account restriction.

Cancellations

Artwork & Design Services
All artwork, including but not limited to logos, designs, mockups, websites, and code, is non-refundable.

Custom Tangible Products
Orders may be canceled within 12 hours of placement, provided no design work has begun and no materials have been purchased.

Orders canceled after this period are non-refundable. If materials were purchased specifically for the order, restocking fees may be billed to the customer.

Rush Orders
Rush orders cannot be canceled once placed.

Additional Fees

Additional charges may apply for rush production, expedited shipping, special materials, or custom requests. All applicable fees will be disclosed at the time of order.

Prices are subject to change based on supply chain conditions, shipping costs, and order volume.

Warranty

Customer-Supplied Products
No warranty is provided for customer-supplied items.

Products & Services
Products and services are covered by a 15-day limited warranty from the date of delivery.

This warranty covers manufacturing defects only. If a defect is confirmed, the product will be replaced with a like item. If a like item is unavailable, a comparable replacement may be offered. No refunds will be issued under warranty.

Disputes

All disputes must be submitted in writing via email to:

Chargebacks filed without prior contact may void warranties and future service eligibility.

Privacy Policy

We collect only the information necessary to fulfill orders and communicate with customers, including name, email address, and phone number.

Customer information may be shared with suppliers strictly for production and fulfillment purposes. We do not sell customer data to third parties for marketing purposes.

By using our website, the customer consents to this privacy policy.

Intellectual Property

All artwork and creative assets produced by Red Earth Innovations, LLC remain its exclusive intellectual property unless otherwise agreed in writing.

Red Earth Innovations, LLC may display, reuse, modify, or distribute artwork for portfolio, marketing, or promotional purposes.

Changes

The seller reserves the right to modify pickup locations, production timelines, delivery methods, or availability due to unforeseen circumstances. Customers will be notified when reasonably possible.

Compliance with Laws

The customer agrees to comply with all applicable local, state, and federal laws related to the purchase, use, and installation of the product.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to conflict-of-law principles.

Entire Agreement

These Terms constitute the entire agreement between the customer and Red Earth Innovations, LLC and supersede all prior written or oral agreements or understandings.
